Bunun dışında talep edilecek tüm verilerde müşterilerin açık rızasına istinaden veya tabi olduğumuz mevzuat başta olmak üzere KVKK md. 5/f.2’de öngörülen diğer hallerde, siz müşterilerimize katma değerli hizmetler, fırsat ve olanaklar sunulması ve hizmet kalitesinin artırılması amacıyla; Şirketimizin ortakları ve ileride SHARK INSTRUMENTS SANAT ÜRÜNLERİ A.Ş. ve/veya olması halinde grup Şirketlerine dahil olacak yurt içinde ya da yurt dışındaki iştiraklerimizle ve doğrudan veya dolaylı bağlı şirketlerimizle ve ortak girişimlerimizle veya yasal bir zorunluluk gereği bu verileri talep etmeye yetkili olan kamu kurum veya kuruluşları ile ve yeterli önlemler alınmak kaydıyla, faaliyetlerimiz gereği anlaşmalı olduğumuz kurumlar, tedarikçiler, yetkili satıcılar/bayiiler/iş ortaklarımız ile paylaşabilecektir. Şirketimizin ortakları için www.sharkguitars.com veya www.ito.org.tr internet adresinden bilgi edinebilirsiniz.
D) Kişisel Veri Toplamanın Yöntemi
Kişisel verileriniz, yürürlükteki mevzuata uygun şekilde; Şirketimiz, Ortaklarımız, iştiraklerimiz, bayilerimiz, tedarikçilerimiz, iş birliği yaptığımız ya da sözleşme ilişkisi bulunan çözüm ortaklarımız gibi kanallar aracılığıyla sözlü, yazılı ya da elektronik ortamda toplanabilir.
E) Kişisel Verilerinizin Doğru ve Güncel Olarak Muhafaza Edilmesi
Kişisel verilerini şirketimizle paylaşanlar, bu bilgilerin doğru olmasının ve güncel bir şekilde muhafaza edilmesinin, hem 6698 Sayılı Kişisel Verilerin Korunması Kanunu anlamında kişisel verileri üzerinde sahip oldukları haklar hem de ilgili diğer mevzuat açısından önemli olduğunu bildiklerini ve yanlış bilgi verilmesinde doğacak sorumlulukların tamamen kendilerine ait olacağını, kabul ve beyan etmişlerdir.
Paylaşmış olduğunuz kişisel verileriniz ile ilgili değişiklik ve/veya güncellemeleri info@sharkguitars.com adresinden bildirebilir veya üyelik hesabınızdan yapabilirsiniz.
F) Kişisel Veri Saklama Süresi
6563 Sayılı Elektronik Ticaretin Düzenlenmesi Hakkında Kanun uyarınca; onayın geri alındığına ilişkin kayıtlar bu tarihten itibaren 1 yıl, ticari elektronik iletinin içeriği ve gönderiye ilişkin diğer her türlü kayıt ise gerektiğinde Bakanlığa sunulmak üzere 3 yıl saklanacaktır. Süre geçtikten sonra kişisel verileriniz tarafımızca veya talebiniz üzerine silinir, yok edilir veya anonim hale getirilir. Ayrıca 5651 Sayılı İnternet Ortamında Yapılan Yayınların Düzenlenmesi ve Bu Yayınlar Yoluyla İşlenen Suçlarla Mücadele Edilmesi Hakkında Kanun uyarınca işlediğimiz trafik verileri 2 yıl saklanır ve süre bittikten sonra anonim hale getirilir.
G) Kişisel Verilerinizin Silinmesi, Yok Edilmesi veya Anonimleştirilmesi
İşbu Bilgilendirme metninde belirtilen amaçlarla işlenmiş olan kişisel verileriniz; KVKK md. 7/f.1'e göre işlenmesi gerektiren amaç ortadan kalktığında ve Kanunların belirlediği süreler geçince tarafımızca silinecek, yok edilecek veya anonimleştirilerek kullanılmaya devam edilecektir.
H) Kişisel Verilerin Korunmasına İlişkin Önlemler
Kişisel verilerin korunması, şirketimiz için önemli bir konudur. Şirketimiz, kişisel verilere yetkisiz erişim veya bu bilgilerin kaybı, hatalı kullanımı, ifşa edilmesi, değiştirilmesi veya imha edilmesine karşı korumak için gerekli önlemleri almaktadır. Şirketimiz, kişisel verilerinizi gizli tutmayı, gizliliğin sağlanması ve güvenliği için gerekli teknik ve idari her türlü tedbiri almayı ve gerekli özeni göstermeyi taahhüt etmektedir.
Şirketimizin gerekli bilgi güvenliği önlemlerini almasına karşın, web sitesine ve sisteme yapılan saldırılar sonucunda kişisel verilerin zarar görmesi veya üçüncü kişilerin eline SHARK INSTRUMENTS SANAT ÜRÜNLERİ A.Ş. (www.sharkguitars.com) Kişisel Verilerin Korunması Hakkında Bilgilendirme 4 geçmesi durumunda, Şirketimiz bu durumu derhal sizlere ve Kişisel Verileri Koruma Kurulu’na bildirir.

Şirketimize başvurarak kişisel verilerinizin;
a) işlenip işlenmediğini öğrenme,
b) işlenmişse bilgi talep etme,
c) işlenme amacını ve amacına uygun kullanılıp kullanılmadığını öğrenme,
ç) yurt içinde / yurt dışında aktarıldığı 3. kişileri bilme,
d) eksik / yanlış işlenmişse düzeltilmesini isteme,
e) KVKK’nın 7 nci maddesinde öngörülen şartlar çerçevesinde silinmesini / yok edilmesini isteme,
f) aktarıldığı üçüncü kişilere yukarıda sayılan (ç) ve (d) bentleri uyarınca yapılan işlemlerin bildirilmesini isteme,
g) münhasıran otomatik sistemler ile analiz edilmesi nedeniyle aleyhinize bir sonucun ortaya çıkmasına itiraz etme,
ğ) kanuna aykırı olarak işlenmesi sebebiyle zarara uğramanız hâlinde zararın giderilmesini talep etme hakkına sahipsiniz.

This User Terms contains the general terms about the use of the web site www.sharkguitars.com and the general rules and legal obligations required to be followed by the Users, to that extent. You declare, by using this site and filling up the form in which your personal information is enrolling, that you agree with the User Terms.
SHARK INSTRUMENTS SANAT ÜRÜNLERİ A.Ş ("SHARK") reserve the authority to alter this User Terms at any time.
1. Using and Security Rules
It is free to use the site www.sharkguitars.com. However, under certain circumstances, the site management may prevent the site using of the user and reserve the right to take legal actions regarding the person or persons attempting to do below mentioned actions:
If the given personal information by the user, in order to register to the site, is incorrect, deficient, deceptive and containing unlawful statements incompatible to general moral rules,
If the site content is partly or wholly copied without permission,
If the usage right of the information provided to the users or designated by the users, such as user name, password, is shared with third parties or institutions or if this information is used by persons apart from the user,

All of the domain name, logo, trademark, working method and similar each materials ("Materials") and all kinds of intellectual and industrial property rights to that extent, involved in the site content, are pertaining to SHARK under legal protection; shall not be used for any commercial or personal purposes, without permission or without giving a reference. It is prohibited to publish any element, available in this site, on any other media or internet site or to use without SHARK's permission.
The software used for the design, organization of the website and for creating a data site is pertaining to SHARK and the copy or usage of this software without permission is strictly forbidden.
The right of re-publishing of all comments, advises and reviews delivered to that web site, with public access, is pertaining to SHARK. SHARK may use these advises, reviews and writings with marketing purposes.
3. Liabilities
The information of users (visiting duration, time, pages displayed) is followed in order to provide them a better service. This information may be shared concerning the advertising purposes etc., with the firms that we are in cooperation by respecting the privacy terms, in order to expand and enhance the content.

The User accepts that all of the provisions of this user terms will be considered accepted by the user by the date when the User begins to benefit from the site services. The User accepts to indemnify all kinds of damages that SHARK incurs, due to the user's breach of any obligation undertaken on this agreement. SHARK has the right of recourse for all kinds of indemnification and/or administrative/punitive fines required to be paid to public institutions and/or to third parties, due to the User's breach of the agreement.
4. The Rights and Liabilities of SHARK
SHARK accepts and undertakes that the user duly registered to the www.sharkguitars.com site will benefit from the services defined under the agreement, except for the technical faults. www.sharkguitars.com / SHARK have the right to investigate and disclose the User's identity information in case that any electronic sabotage or attempt on the purpose of intervention of savings, preventing the operation of the www.sharkguitars.com site, is identified and/or that any attempt causing a cyber attack is determined, that any criminal complaint against the user by the public authorities is filed or any official investigation is demanded.
SHARK may unilaterally alter these user terms without any notice, in order to maintain the continuity of the undertaken services. SHARK will publish on its website the new updated user terms with new updated date, under the same link, in case of any alteration, and will inform its users via e-mail, if required. The new updated user terms will be valid as from their publication on www.sharkguitars.com and the usage of this site and its services will be subject to the updated user terms as from that moment.
The membership of a member which sends any materials against this agreement's provisions may be unilaterally terminated by SHARK without any notice.
5. The Entry Into Force of The User Terms
As from the filling up and approval of the registration form or from the receiving of any service or from giving of any order by using this system, it is considered that the User accepts and undertakes to comply with the User Terms.
6. The Competent Court and Resolution of Disputes
Istanbul Courts and Execution Offices are authorized for the resolution of the disputes arising from the execution of this agreement.
7. Notification Addresses
The e-mail address declared to www.sharkguitars.com by the User will be considered as the e-mail address from which the legal address is demanded in order for all kinds of notifications in relation to this agreement.
The parties accept that the requests made to their former e-mail address are valid and related to them, unless they notify the other party in writing, within 3 (three) days, about the alterations on their current e-mail address.
It will be considered that all kinds of notifications send by www.sharkguitars.com to the registered e-mail address of the User, are delivered 1 (one) day after their sent date.
The User declares and undertakes that all of the provisions of the User Terms are read, understood and accepted by his/herself.
Giriş
1.1. SHARK INSTRUMENTS SANAT ÜRÜNLERİ A.Ş. (bundan sonra SHARK kısa adıyla ifade edilecektir), kullanıcılarına Müzik enstrümanları, bu enstrümanların alt ürün ve aksesuarlarını üretmek ve www.sharkguitars.com internet sitesi üzerinden sahip olmalarını sağlamak için kurulmuştur. Söz konusu hizmetin eksiksiz ve kusursuz olması için üyelerimizin de site kullanım şartlarına uyması gerekmektedir.
1.2.Kullanıcılar, Kullanıcı formunu doldurmak suretiyle www.sharkguitars.com üye olmakla işbu sözleşmenin içerdiği hükümleri okuduklarını, anladıklarını, kabul ettiklerini ve onayladıklarını kabul ve taahhüt etmektedirler.
Taraflar ve Tanımlar
2.1.İşbu Üyelik Sözleşmesi bir taraftan Koşuyolu Mah. Cenap Şahabettin Sok.
No:16 Kadıköy - İSTANBUL adresinde mukim SHARK INSTRUMENTS SANAT ÜRÜNLERİ A.Ş. ile www.sharkguitars.com internet sitesine üye olan ve internet sitesi altında sunulan hizmetleri kullanan ("Kullanıcı") arasında elektronik olarak onaylamıştır.
2.2. SHARK ve Kullanıcı tek tek “Taraf” ve birlikte “Taraflar” olarak anılacaktır.
2.3.SİTE: SHARK’ın kullanıcılarına hizmet verdiği www.sharkguitars.com alan adlı web sitesidir.
2.4.Kullanıcı/Üye: Site’ye üye olarak hizmet almaya başlayan gerçek ve/veya özel veya tüzel kişiliktir.
2.5.Mal/Ürün: SİTE’de satışa arz edilen çeşitli müzik enstrümanları ve bunların yan ürünlerinden ibarettir.
Sözleşmenin Konusu
3.1. İşbu sözleşme ile SHARK, www.sharkguitars.com alan adında ve buna bağlı sitesinde duyuracağı diğer alt alan adlarında, siteye üye olacak Gerçek ve/veya Tüzel kişi kullanıcılarına müzik aletleri ve yan ürünlerini üreterek müşterilerine satışının sağlandığı ilgili sitede tarafların karşılıklı hak ve yükümlülükleri düzenlenmektedir.
Üyelik Bilgileri
4.1. SHARK e-ticaret platformu üzerinde elektronik posta hesabınız ile üyelik oluşturulması temel kuraldır. Daha önce aynı e-posta adresiniz ile üye olmuşsanız yeni üyeliğiniz kabul edilmeyecektir.
4.2. Kullanıcı, SHARK e-ticaret platformuna üye olurken vermiş olduğu tüm bilgilerin doğru ve tam olduğunu, sahte olmadığını, iş bu bilgilerin sahte ve/veya yanlış olmasından kaynaklanabilecek her türlü zarardan ve ziyandan sorumlu olduğunu, Site’nin bu yönde uğrayabileceği her türlü zararı tazmin edeceğini kabul, beyan ve taahhüt eder.
4.3. SHARK e-ticaret platformundan satın aldığınız ürünlerin size süresi içerisinde teslim edilebilmesi için üyelik bilgilerinin gerçeğe uygun ve eksiksiz bir şekilde doldurulması gerekmektedir. Üyelik bilgilerinin yanlış veya hatalı doldurulması neticesinde teslimatınız taahhüt edilen süre içerisinde yapılamaması durumunda SHARK herhangi bir sorumluluk kabul etmez.
Ticari Elektronik İletiler Hakkında
5.1. SHARK’a Üye olurken verdiğiniz, elektronik mail adresi, telefon ve/veya cep telefonunuz aracılı ile 6563 sayılı Kanun ve Ticari İletişim Ve Ticari Elektronik İletiler Hakkında Yönetmelik gereğince tarafınıza pazarlama ve tanıtım amaçlı Ticari Elektronik İleti gönderilebilir. Üye, dilediği zaman bu gönderimlerden ücretsiz olarak çıkarak pazarlama ve bilgilendirme amaçlı iletileri almama hakkına haizdir.
5.2. SHARK’a Üye tarafından pazarlama ve tanıtım amaçlı elektronik ileti gönderimine ilişkin tüm onay kayıtları, onayın geçerliliğinin sona erdiği tarihten, ticari elektronik iletilere ilişkin diğer kayıtları ise kayıt tarihinden itibaren bir yıl süreyle saklar
Genel Hak ve Yükümlülükleri
6.1. SHARK, iş bu sözleşme konusu www.sharkguitars.com isimli alan adını sunduğu hizmetin kalitesine zarar vermemek şartı ile farklı bir alan adı ile müşterilerine hizmet vermeye devam edebilir.
6.2. Kullanıcı, www.sharkguitars.com adresinden hizmet kullanırken elde ettiği bilgileri, işbu sözleşme ve eki niteliğinde olan gizlilik bildirimi ve politikası hükümleri çerçevesinde haricinde üçüncü kişilerle paylaşmayacağını kabul ve taahhüt eder.
6.3. Kullanıcı, SİTE üyeliğinin, Kullanıcı bilgilerinin, Kullanıcı şifresinin gizliliği için gerekli tedbirleri alır (Kullanıcı şifresi hiçbir şekilde ard-arda gelen sayılardan oluşturulmamalıdır. Kullanıcı şifresi 19 ve 20 sayıları ile başlamamalı ve her 2 ayda bir değiştirilmelidir.) Kullanıcı şifresinin üçüncü şahısların eline geçmesinden kaynaklanacak hukuki sorumluluk tamamen Kullanıcıya aittir. Kullanıcı şifresinin 3. Kişilerin eline geçmesi neticesinde 3. Şahısların uğrayacağım tüm maddi veya manevi zararlar Kullanıcı’ya ait olacaktır. İş bu sebeple; SHARK herhangi bir şekilde 3. gerçek ve/veya tüzel kişilere tazminat ödemesi halinde, Kullanıcı’dan zararını rücu edebilecektir.
6.4. Üye olurken rızanız ile verdiğiniz e-posta adresi, adınız ve soyadınız, ikamet adresiniz, telefon numaranız sizin kişisel bilgilerinizi oluşturmaktadır. SHARK gizlilik politikası gereğince, iş ortakları ile size aldığınız hizmeti ulaştırmak, yeni ürünlerin ve hizmetlerin duyurularını yapmak üzere bu bilgiler kullanılabilecektir. SHARK sitesi içerisinde yapmış olduğunuz işlemler ve bağlantı kayıtları “kredi kartı ve ödeme bilgileriniz” hariç olmak üzere yasal yükümlülükler nedeni ile tutulacaktır. Bu bilgileri SHARK’ın site istatistik verilerini elde etmek için kullanabilir .
6.5. SHARK e-ticaret platformundan satın alacağınız ürünler “stok” miktarları ile veya tek seferde alabileceğiniz maksimum ürün miktarı ile sınırlanmış olabilir. Getirilen sınırlama ürün sayfasında ayrıntılı bir biçimde belirtilmektedir. Çevrimiçi alışverişin kolaylığı ve aynı anda farklı sipariş alma imkanı bulunması sebebi ile ilgili ürün tarafınızdan satın alınmadan önce tükenmiş olabilir. İş bu sebeple SHARK internet sitesinde satışa arz edilen her ürünün tarafınızdan satın alınması garantisini vermez.
6.6. SHARK, verdiği hizmetler gereği Tüketici’nin Korunması Hakkındaki Kanun, Mesafeli Satışlar Yönetmeliği ve atıf yaptığı durumlarda Kapıdan Satışlar Hakkındaki yönetmelik gereğince satış koşullarını ve haklarınızı belirlemektedir. Satın alma ile ilgili yasal haklarınız ayrıca “satış ekranında” sunulacaktır. Tüketici sıfatı taşımayan alıcılar bakımından TKHK hükümleri yerine genel hükümler, Türk Ticaret Kanunu ve Borçlar Kanunu’nun ilgili maddeleri geçerli olacaktır. Ürün seçimi ve devamında satın almak istediğiniz ürün ile ilgili ön bilgilendirme formu tarafınıza elektronik ortamda gönderilecektir.
6.7. SHARK elektronik ticaret platformunda satışa arz ettiği ürünlerin özelliklerini her zaman tam ve eksiksiz sunmaya gayret etmektedir. Ancak ürünlerin internet üzerinden gösterilmesi için fotoğraf ve ürünlerin ve kullanılan sistemin teknik özellikleri nedeni ile renkleri ve/veya boyutlarında önem arz etmeyen farklılıklar olabilir.
6.8. SHARK; Site’de üyeler tarafından üye olurken ve satın alma işlemi yapılırken 5651 sayılı kanun ve diğer genel hükümler gereğince abonelik bilgilerini ve log kaydını tutmaktadır. Söz konusu kayıtlar yasal nedenler hariç hiçbir kurum ve kuruluş ile paylaşılmaz.
6.9.Taraflar arasında ve tarafların yetkililerince yapılan e-posta, anlık mesaj, Kullanıcı’nın hizmet aldığı sunucu kayıtları, SHARK’ın sunucu kayıtları, tüm dijital delilleri ve faks gibi elektronik yazışma kayıtları, kanunen geçerli delil sayılarak, usul hukuku bağlamında delil olarak kabul edilmiştir.
6.10.Tarafların iradesi dışında ortaya çıkan, resmi şekilde belgelenebilen ve işbu sözleşme ile yüklendikleri borçlarını yerine getirmelerini engelleyici ve/veya geciktirici hallerin meydana gelmesi (örneğin grev, lokavt, iç savaş, savaş, terör eylemleri, deprem, yangın, sel vb doğal afetler, devletin karar ve eylemleri vb) mücbir sebep hali olarak değerlendirilecek olup, Tarafların mücbir sebep dolayısıyla yükümlülüklerini tam ve zamanında yerine getirememesi halinde sözleşme kendiliğinden askıya alınacak olup, mücbir sebebin 10 günden fazla uzaması halinde ise taraflar bir araya gelerek sözleşmenin devamı, askıya alınması, feshi veya bir başka şekilde tasfiye şeklini müzakere edecektirler.
6.11. İşbu sözleşmenin herhangi bir hükmü veya hükümleri yürürlükteki kanunlara aykırı olması halinde herhangi bir surette geçersiz veya ifa edilemez bir hale gelirse, sözleşmenin diğer hükümleri geçerli ve yürürlükte kalacaktır. Bu durumda, Taraflar, geçersiz sayılan veya ifa edilemeyen kısım veya hükmün yerine, geçersiz bölüm veya hükmün amacına uygun yeni bir hüküm veya bölüm eklemek için ellerinden gelen azami çabayı sarf edeceklerdir.
6.12.İş bu sözleşmenin uygulanması sırasında doğacak her türlü uyuşmazlığın çözümünde Türk Hukuku uygulanacak olup İstanbul Anadolu Mahkemeleri ile İcra Daireleri yetkili ve görevlidir.
İş bu 6 maddeden oluşan Üyelik Sözleşmesi .......... tarihinde 2 (iki) nüsha olarak taraflar arasında elektronik ortamda akdedilmiş olup, bir nüshası ÜYE’ye elektronik ortamda iletilerek taraflar arasında yürürlüğe girmiştir.
Yukarıda belirtilen kullanım şartları, Üyelik işlemlerinin tamamlanması ile tarafınızdan onaylanmıştır.
